This Privacy Policy describes the policies and procedures of PT Aino Indonesia (referred to as the “Company” or “We” or “Us” or “Our” in this Agreement) regarding the acquisition and collection, processing and analysis, storage, improvement and renewal, appearance, announcement, transfer, dissemination, or disclosure, and/or deletion or display,and disclosure of your information when You use the Services and inform You of your privacy rights and how the law protects You. Interpretation
Words that are originally capitalized have meanings defined under the following conditions. The following definitions will have the same meaning regardless of whether they appear in the singular or plural.

i. The Forum refers to any institution selected and agreed upon by you and the Company to resolve any disagreements or disputes that arise, apart from arbitration. This forum may include, but is not limited to, mediation, negotiation, or conciliation proceedings that have legal and relevant jurisdiction over the dispute that occurs. The forum in question is an alternative means that is preferred in resolving disputes in good faith before proceeding to arbitration proceedings.
j. Third-Party Social Media Services refer to any social networking website or website where Users may log in or create an account to use the Services.
k. Service refers to the App or Website or both.
l. The state refers to Indonesia.
m. Service Provider means any natural person or legal entity that processes data on behalf of the Company. It refers to a third-party company or individual employed by the Company to facilitate the Service, to provide the Service on behalf of the Company, to perform services related to the Service or to assist the Company in analyzing how the Service is used.
n. Device means any device that can access the Services, such as a computer, mobile phone or digital tablet.

In the event of any discrepancy between the Indonesian version of this Privacy Notice and any other language version, the Indonesian version shall prevail. The difference in question can be differences in the interpretation of terms, word selection, sentence structure, or meaning resulting from translation. In the event of any inconsistency between the two versions, including but not limited to inconsistencies in the delivery of information, legal understanding, rights and obligations of the parties, or the policies described, the Indonesian version shall be used as a valid and dominating reference in resolving any such differences.
Q. Choice of Law and Jurisdiction
In the event of a difference of opinion or dispute arising out of or relating to the use of choice of law and jurisdiction, You and We agree to first try to resolve it in an amicable manner through consensus deliberation. However, You and We in good faith also agree not to rule out the possibility of using other mutually agreed forums, either through mediation, negotiation, or conciliation that has jurisdiction over such disputes. This choice to take another forum shall not prejudice your and Our rights to ultimately resolve the dispute by arbitration in accordance with the provisions of this clause.
Meanwhile, the legal choice that will be applied in this case is Indonesia law. If the deliberations do not reach an agreement, the settlement will continue through arbitration in accordance with the applicable provisions of the Indonesia National Arbitration Board (BANI). The arbitration proceedings will be conducted in Indonesia and the resulting decision will be final and binding on the parties.
R. Force Majeure
1. Force Majeure events include but are not limited to:
a. There was a war;
b. There was general public chaos: Riots, insurrections, sabotage, disturbances, violent demonstrations;
c. Natural disasters: Floods, landslides, earthquakes;
d. Non-natural disasters: Epidemics, pandemics;
e. Malfunction of the power source.
2. During the occurrence of Force Majeure, the Company and the bus operator are not responsible for any delays, cancellations, or interruptions of service. You will be notified of the situation immediately.
3. You are expected to follow the directions and information provided during the Force Majeure period.
4. You and the Company are exempt from the compensation provisions if the losses suffered are caused by theForce Majeure event provided that You who experience Force Majeure:
a. Submit immediately oral notice no later than 3 (three) calendar days and followed by written notification no later than 14 (fourteen) calendar days from the incident in question;
b. Immediately take all appropriate and reasonable actions and efforts to correct or overcome the incident or consequences caused by the Force Majeure event;
5. Submit written notice of the end of Force Majeure no later than 3 (three) calendar days;
6. The provisions of paragraphs (a), (b), and (c) shall not apply if the Force Majeure in question is a National Force Majeure announced by a competent government agency and is generally known to each other between You and the Company;
S. Others
If one or more of the provisions of this Privacy Policy are held to be invalid, void, contrary to law, or unenforceable under any applicable law or ruling, that provision will be deemed invalid and as if it never existed. Notwithstanding the foregoing, this shall not affect the validity, validity or enforceability of any other provisions contained in this Privacy Policy, which shall remain in full force and effect.
